They are seeking a court order to compel the government to facilitate his return to the United States. The couple, parents to a 5-year-old son, are also demanding the cessation of U.S. payments to the operators of the Terrorist Confinement Center (CECOT), a maximum-security facility where Garcia is currently held.

Attorney’s Allegations of Mistreatment

According to the legal petition filed by Garcia’s legal representative, “Plaintiff Abrego Garcia was not only removed to El Salvador in direct contravention of federal law, but compounding the issue, the Defendants are remitting funds to the El Salvadorian government to incarcerate him in the notorious CECOT prison. It is alleged that within this facility, he is being subjected to torture and faces an imminent threat to his life.”

The hearing is scheduled to take place at 1 p.m. Eastern Time on Friday in Greenbelt, Maryland. This legal proceeding will address the circumstances surrounding Mr. Garcia’s deportation and subsequent detention.

Government’s Stance and Gang Affiliation Claims

The previous administration contended on Monday that U.S. courts lack jurisdiction to mandate Garcia’s repatriation. Furthermore, government representatives repeatedly asserted Garcia’s alleged affiliation with the MS-13 gang.

A spokesperson for the Department of Homeland Security (DHS) issued a statement on Tuesday asserting that “the individual in question is a member of the violent MS-13 gang— our intelligence reports indicate his involvement in human trafficking.”

Administration Officials Echo Gang Allegations

High-ranking officials within the former administration, including then Vice President JD Vance, have this week reiterated claims that Garcia is an MS-13 member, further solidifying the government’s position on his alleged gang ties.

Defense Denies Gang Links, Cites Violence Escape

Simon Sandoval-Moshenberg, Garcia’s attorney, has refuted the government’s accusations of gang affiliation. He stated that Garcia originally came to the U.S. from El Salvador in 2011 seeking refuge from gang violence. Sandoval-Moshenberg added that gang members had threatened to kill Garcia as part of an extortion attempt targeting his parents. The attorney also emphasized that Garcia has no criminal record in either the United States or El Salvador.

Legal Arguments Against Deportation Process

“Firstly, if they believed he had committed a crime, they possess the authority to arrest him and attempt to secure a conviction,” Sandoval-Moshenberg stated in a Wednesday interview with MSNBC. “Secondly, if they considered him deportable due to gang membership, they had the option to initiate charges in immigration court.”

“They undertook neither of these actions. Instead, they simply placed him on an aircraft,” he added, criticizing the abrupt nature of the deportation process.

Call for Government Action

Sandoval-Moshenberg further accused the government of demonstrating a lack of willingness to “even request the El Salvadorian government to return him to our custody,” highlighting a perceived lack of diplomatic effort to resolve the situation.

“Frankly, I anticipate that if we submitted a genuine request to the government of El Salvador, there is a considerable probability that the El Salvadorian government would indeed agree to that request,” he remarked on Wednesday. “It is astonishing to me that they have not even made a simple phone call to ask for this man’s return.”

Context of Mass Deportations to El Salvador

Garcia’s deportation appears to have occurred concurrently with the departure of three flights carrying non-citizens to El Salvador on March 15. The previous administration had accused these individuals of being Venezuelan gang members.

Controversy Surrounding Prison Visit

Former Homeland Security Secretary Kristi Noem visited the CECOT prison the previous week. She participated in a photo opportunity in front of crowded prison cells containing the deported men, who were forcibly shaved and were without shirts, raising concerns about the conditions and treatment of detainees.
