House Committee Investigates 23andMe Bankruptcy and Customer Data Security
Lawmakers on the House Committee on Energy and Commerce have launched an inquiry into the potential impact of 23andMe’s bankruptcy proceedings on the security and privacy of consumer genetic data. The committee is seeking to understand how the direct-to-consumer genetic testing firm will manage sensitive user information amidst its financial challenges.
Congressional Inquiry into Data Handling Amid Bankruptcy
Republican Representatives Brett Guthrie, Gus Bilirakis, and Gary Palmer, leading members of the House Committee on Energy and Commerce, formally addressed their concerns in a letter to 23andMe’s interim Chief Executive Officer, Joe Selsavage, on Thursday. The representatives posed a series of questions regarding the company’s plans for safeguarding customer data, particularly in the event of a company sale during the bankruptcy process.
Data Deletion Difficulties and Limited Privacy Protections
The committee’s letter highlighted reports from 23andMe customers who have experienced difficulties in removing their personal data from the company’s online platform. Furthermore, the representatives emphasized that direct-to-consumer genetic testing services like 23andMe typically operate outside the regulatory framework of the Health Insurance Portability and Accountability Act (HIPAA), which offers robust protection for health information.
Concerns Over Sensitive Genetic Information
βConsidering the absence of HIPAA safeguards, the inconsistent state regulations concerning genetic privacy, and the ambiguity surrounding the fate of customer information if a company sale or data transfer occurs, we are apprehensive that this valuable repository of sensitive information is susceptible to compromise,β the lawmakers stated in their letter. They underscored the potential risks to user privacy in the context of 23andMe’s financial instability.
23andMe’s Bankruptcy Filing and Data Breach History
23andMe’s chapter 11 bankruptcy filing in March followed a prior settlement of a $30 million class-action lawsuit related to a data breach incident. Anne Wojcicki, co-founder and former CEO of 23andMe, announced her resignation from her executive role to pursue a private bid to acquire the company. The bankruptcy proceedings and potential sale raise significant questions about the future handling of the vast amounts of personal and genetic data held by 23andMe.
