Resentencing Recommendation by District Attorney
Currently, Lyle and Erik Menendez remain incarcerated. While they have not been granted parole nor officially released from prison, Los Angeles County District Attorney George Gascón announced on October 24, 2024, a formal recommendation to the court. Gascón proposed “that the life sentence without the possibility of parole be removed,” effectively suggesting the brothers be resentenced for murder, thus making them eligible for parole consideration should the court accept the resentencing.
“I believe that they have fulfilled their societal debt,” Gascón stated regarding Lyle and Erik. He highlighted their demonstrated rehabilitation during their imprisonment, noting their efforts in “creating groups to manage unresolved trauma, establishing support systems for inmates with physical disabilities who might face differential treatment,” as the District Attorney emphasized.

Gascón acknowledged Lyle’s involvement in “negotiating for fellow inmates regarding their living conditions,” while underscoring, “there is no justification for murder.”
The District Attorney further mentioned the significant public support following the premiere of Monsters: The Lyle and Erik Menendez Story, and recognized the fresh evidence reinforcing the brothers’ allegations of sexual abuse. Gascón clarified that while Lyle and Erik’s decision to murder their parents was reprehensible, they have since matured.
“All of this was perpetrated by two young individuals,” the DA added, referencing Lyle and Erik’s ages of 21 and 18, respectively, at the time of the fatal shooting. “They are no longer juveniles. They faced no prospect of release from prison. … I am convinced that the brothers endured substantial dysfunction within their family environment and instances of molestation.”
Los Angeles District Attorney Nathan Hochman assumed office in December 2024. Since his appointment, he has asserted the brothers’ lack of candor. Speaking to ABC News, Hochman stated, “If they genuinely and unequivocally admit, for the first time in over 30 years, the full scope of their criminal actions and all the associated falsehoods.” A resentencing hearing, initially scheduled for April 17, 2025, has been temporarily suspended.
Menendez Brothers’ Parole Eligibility
Should the court proceed with Lyle and Erik’s potential resentencing, they would likely become eligible for parole, possibly leading to their release. Since 2018, the brothers have been housed at the Richard J. Donovan Correctional Facility in San Diego.
