A recently rediscovered legal document indicates that tech mogul Elon Musk engaged in a legal conflict with prominent actress Amber Heard concerning embryos they created together. This revelation emerges amidst ongoing discussions around Musk’s growing number of children and unconventional family planning.
Resurfaced Legal Dossier Reveals Embryo Battle
Heard, who has maintained a lower public profile since her high-profile defamation trial with former spouse Johnny Depp, has been notably secretive regarding the paternity of her daughter, asserting she serves as both ‘mom and dad.’
However, a declaration from the 2022 Depp v. Heard legal proceedings, signed by Jennifer Howell, a close associate of Heard’s sister Whitney, alleges that Heard and Musk had intended to have children jointly. Their relationship spanned intermittently from 2016 to 2018.
In her statement, Howell contended that Heard was ‘in a legal battle’ with Musk ‘over embryos they had created together,’ stating Musk ‘wanted to destroy them, and Amber tried to keep them to have a baby.’
Jennifer Howell’s Testimony and its Exclusion
Howell’s testimony was not admitted as evidence in the Depp v. Heard trial. Heard’s legal team argued that Depp’s lawyers improperly obtained the declaration.

Heard, currently residing in Madrid, Spain, away from Hollywood, welcomed her daughter Oonagh in April 2021 through surrogacy. The 38-year-old has not publicly revealed the identity of her daughter’s father. In December, she announced her anticipation of a second child.

Renewed speculation about Musk’s potential children with Heard has emerged following recent reports detailing the billionaire’s desire to father a ‘legion’ of offspring. It’s reported that Musk, now publicly acknowledged as a father of at least 14 children with four different women, has established confidential financial agreements with multiple mothers.
Musk’s Desire for a ‘Legion’ of Offspring
Ashley St. Clair, a 26-year-old political commentator, has identified herself as one of the mothers, alleging she received a $15 million upfront payment and a $100,000 monthly stipend in exchange for discretion regarding their child.
Citing ‘multiple sources close to the tech entrepreneur,’ The Wall Street Journal reports that the actual number of Musk’s children is believed to be ‘much higher than publicly known.’
Ashley St. Clair’s Claims and Financial Agreements
During the Depp v. Heard trial, rumors circulated suggesting Musk was the father of Heard’s child, fueled by statements from Howell. Howell described herself as the ‘chosen sister’ of Heard’s sister, Whitney, who was also employed by Heard.
Whitney Heard dismissed Howell’s claims in her signed testimony as ‘complete fiction,’ and the testimony was subsequently excluded from the court proceedings.
Howell also asserted that Heard’s mother, Paige, characterized Musk as ‘controlling and abusive,’ and said that Depp was ‘an angel or a saint in comparison.’
Howell further stated that a charity she managed received an anonymous donation of $250,000 ‘on behalf of Amber Heard,’ which she believed at the time of her declaration was from Musk.
The report details Musk’s inclination towards using surrogates, purportedly with the intention of creating a ‘legion’ of offspring ‘before the apocalypse.’
Musk said in 2024, ‘I mean, you know, you’ve got to walk the talk. So, I do have a lot of kids, and I encourage others to have lots of kids.’
The publication reports that Musk is receptive to offering his sperm to women with whom he does not have a romantic relationship.
In one instance, ‘Japanese officials’ reportedly approached Musk to be a sperm donor for a ‘high-profile woman.’
Tiffany Fong’s Rejection of Musk’s Proposal
St. Clair indicates Musk agreed to this proposition.
He reportedly texted St. Clair during discussions about the offer, ‘They want me to be a sperm donor. No romance or anything, just sperm.’
In another instance, Musk allegedly contacted cryptocurrency influencer Tiffany Fong after discovering her X (formerly Twitter) account.
After weeks of engaging with her online content, which purportedly led to a surge in her followers, Musk allegedly proposed they have a child together.
The pair had never met, and Fong reportedly declined his proposal, as she envisioned a traditional nuclear family for herself in the future.
Jared Birchall’s Role as ‘Fixer’
The report also identified Jared Birchall, a close associate of Musk, as his ‘fixer,’ who manages negotiations with women Musk selects to have children with.
Birchall reportedly discusses Musk’s financial offer with the women and outlines the terms of the agreement. St. Clair asserts that discretion is paramount.
St. Clair recounted that Birchall stated, ‘We have been through way too many issues where, to not sign some agreement associated with handing over 15-plus million dollars is absolutely insane and irresponsible.’
‘We have dealt with some very unstable, mentally unstable, people that all of a sudden misremember things.’
St. Clair suggests Birchall implied that other women have signed similar confidentiality agreements.
Musk is publicly known to have children with four women: six with his former wife, Justine; three with musician Grimes; four with Shivon Zilis, a former employee; and one with St. Clair.
According to the report, ‘A person familiar with Musk’s thinking on the agreements with the mothers of his children said that Musk believes it is better to resolve these matters behind closed doors for the safety and security of the child.’

Heard disclosed in July 2021 that she had welcomed her daughter, Oonagh Paige, via surrogacy in April of that year.

Sharing another photograph of Oonagh, she commented, ‘I’m just the mom and the dad. She’s the boss.’

Around the time Heard decided to have a child, she was in a relationship with Musk.
The two became acquainted at the 2016 Met Gala. During the Depp trial, Heard characterized Musk as ‘a real gentleman. He was really nice.’
‘He sat at a nearby table and we got to speaking that night and eventually became friends.’
Romance rumors surrounding the pair emerged weeks after Heard officially filed for divorce, however, they had separated by August 2017.
At that time, Musk commented on Heard’s Instagram, confirming their separation: ‘Although Amber and I did break up, we are still friends, remain close and love one another.’
‘Long distance relationships, when both partners have intense work obligations are always difficult, but who knows what the future holds.’
The couple reconciled by late 2017 but ended their relationship again in early 2018.
