Federal Judge Halts Trump Administration’s Move to Revoke Migrant Protections

A federal judge on Monday prevented the Trump administration from rescinding the legal standing and employment authorization of over 530,000 migrants hailing from Cuba, Haiti, Nicaragua, and Venezuela. In her legal pronouncement, Judge Talwani specified, “The Termination of Parole Processes for Cubans, Haitians, Nicaraguans, and Venezuelans, 90 Fed. Reg. 13611 (Mar. 25, 2025), is hereby STAYED pending further court order insofar as it revokes, without case-by-case review, the previously granted parole and work authorization issued to noncitizens paroled into the United States pursuant to parole programs for noncitizens from Cuba, Haiti, Nicaragua, and Venezuela (the ‘CHNV parole programs’) prior to the noncitizen’s originally stated parole end date.”

The Biden administration established the CHNV program in 2023 utilizing executive parole authority. Although initiated in 2022, it initially focused on Venezuelan nationals before expanding to encompass additional nationalities.

The Biden administration asserted that the CHNV initiative aimed to curtail unlawful border crossings along the southern border, enabling enhanced screening of individuals entering the nation amidst a surge of migrants.

This announcement provided a month’s notice from the formal publication date of March 25.
