The Federal Communications Commission (FCC) has initiated an inquiry into Disney’s diversity, equity, and inclusion (DEI) initiatives, as announced by Chairman Brendan Carr on Friday. This probe represents the most recent move during the Trump administration to scrutinize and potentially curtail DEI programs across various sectors.

FCC Chairman Carr Questions Disney’s DEI Initiatives

In a formal communication addressed to Robert Iger, Disney’s CEO, Chairman Carr stated that the company’s DEI programs, specifically those aimed at enhancing diversity in recruitment and fostering race-based affinity groups, seemingly contravene equal employment opportunity statutes.

“My aim is to ensure Disney genuinely terminates any discriminatory practices, beyond mere superficial adjustments,” Carr conveyed in the correspondence, dated Thursday. “Furthermore, I intend to ascertain whether Disney’s actions, both current and past, have consistently adhered to pertinent FCC regulations.”

A Disney representative affirmed that the corporation is currently reviewing the FCC’s letter. “We anticipate engaging with the commission to address their inquiries,” the spokesperson added.

Broader FCC Scrutiny of Media DEI Policies Under Chairman Carr

Carr, an experienced Republican official, commenced his role as FCC chairman in January by initiating a comprehensive campaign to examine media outlets. This initiative sought to identify and eliminate perceived left-leaning biases and policies deemed unfavorable by the executive branch.

In the preceding month, Carr launched a parallel DEI inspection into Comcast, the parent organization of NBCUniversal. Moreover, Carr indicated that future merger assessments conducted by the agency will encompass probes into companies’ DEI programs.

These investigations follow an executive directive issued by Mr. Trump early in his term, which prohibited “illegal and immoral” DEI programs within the federal government. Subsequently, Carr declared the cessation of any advocacy for diversity and equity in the FCC’s strategic planning, budgetary allocations, and economic reports.

The FCC’s authority to penalize a media corporation for its diversity initiatives remains uncertain. Historically, the FCC’s purview primarily involves licensing broadcast television and radio stations and acting as a regulatory body for cable television. However, Carr posits that the agency can invoke a wide-ranging “public interest” criterion when examining entities like Disney, which operates ABC and ESPN, alongside numerous television stations nationwide.

FCC specialists suggest that potential legal challenges could arise from Carr’s investigations.

“This action is fundamentally about coercion and browbeating,” asserted Andrew Schwartzman, senior counsel at the Benton Institute for Broadband & Society. He further indicated that Carr’s most potent instrument lies in his voting power within the commission concerning the approval of mergers and acquisitions.

Chairman Carr’s Expansion of FCC Mandate and Political Influence

Since assuming the chairmanship, Carr, a presidential appointee of the Trump administration, has initiated inquiries into various news organizations, including PBS and NPR, alleging inclinations of left-leaning political partiality. Among these scrutinies were an examination of a CBS “60 Minutes” interview with former Vice President Kamala Harris and a probe into San Francisco radio station KCBS concerning its reporting on immigration enforcement measures.

Carr has publicly voiced his alignment with the administration’s commitments to reduce regulatory frameworks, target major technology firms, and penalize television networks for perceived political slants. Telecommunications lawyers and analysts have observed that Carr is in the process of transforming the independent agency, broadening its jurisdiction, and employing it as a political instrument for conservative agendas.
