The separation between actors Laura Prepon and Ben Foster, who ended their marriage in 2024, is evolving into a heated divorce dispute.

Us Weekly reported that Foster initiated divorce proceedings against Prepon in November 2024, citing “irreconcilable differences” as the cause and marking September 9, 2024, as their separation date. The former couple has two children: a daughter, Ella, aged 5, and a son born in 2020 whose name remains undisclosed to the public.

Since the initial filing, both Foster and Prepon have engaged in legal back-and-forth through court submissions. Prepon has alleged Foster struggles with alcohol abuse, while Foster has countered with claims of “inappropriate marital conduct” on Prepon’s part.

In his original divorce petition, Foster requested the court to implement an “equitable division” of their shared assets and liabilities, aligning with their prenuptial agreement established in 2018, as per documents acquired by Us Weekly. He also anticipated that he and Prepon would incorporate their “marital dissolution agreement and agreed parenting plan” into the final divorce decree.

December 2024: Custody Dispute and Alcohol Allegations

The subsequent month, Prepon responded to Foster’s court request for a temporary custody arrangement, as they had not reached a mutual agreement. Court documents obtained by Us Weekly reveal that Prepon requested Foster abstain from alcohol for 12 hours prior to and during any period spent with their children. She further suggested the possibility of supervised visitation for Foster.

Prepon’s legal representatives expressed concerns regarding the children’s safety at Foster’s new residence due to his purported “longstanding history of alcohol abuse.” Prepon recounted an incident after their daughter’s birth in 2017 where Foster allegedly became “severely intoxicated,” locking himself out of their New York apartment. She claims to have found him asleep on their doorstep in his underwear.

In her filing, Prepon asserted that Foster failed to return home to see his children after completing a film production in August 2024, having been absent for “almost four weeks.”

“Despite his assurances to [Laura] that he would not attend the Venice Film Festival, [Ben] was indeed seen in Italy on the red carpet, notably without his wedding ring,” the legal documents stated. “Despite [Ben’s] repeated absences and unpredictability, [Laura] has consistently provided a stable environment for the children and maintained their regular routines.”

Foster’s attorney issued a statement to In Touch, addressing Prepon’s legal response, labeling it as “the definition of falsehood and a disturbing fiction.”

March 2025: Counter-Accusations and Marital Conduct

Months after Prepon’s allegations of Foster’s drinking issues, Foster submitted an amended petition. According to documents obtained by In Touch, he accused Prepon of “inappropriate marital conduct.”

“[Ben] respectfully submits that [Laura] has engaged in cruel and inhuman treatment or behavior (specifically; inappropriate marital conduct) towards [Ben] … to such a degree that continued cohabitation is unsafe and improper,” the court documents declared.

Foster requested the court to enforce the prenuptial agreement signed by both parties on May 21, 2018. He further sought the court’s determination on a custody schedule and the amount of child support he would pay to Prepon. Additionally, Foster is seeking to sell their marital home, jointly purchased in 2024.
