Trump signs bill criminalizing revenge porn and explicit deepfakes

Importance Score: 85 / 100 🟢

President Donald Trump approved the Take It Down Act on Monday, a cross-party measure designed to impose tougher sanctions for disseminating non-consensual intimate depictions, encompassing both deepfakes and revenge porn. This revenge porn legislation aims to protect individuals from the damaging effects of non-consensual pornography and similar digitally altered content.

New Federal Law Targets Non-Consensual Explicit Images

The legislation criminalizes the dissemination of such visuals, regardless of whether they are genuine or artificially generated using AI. Individuals who circulate these images or videos could be subject to legal repercussions, which include monetary penalties, incarceration, and victim compensation.

Social Media Platforms Face Stricter Regulations

According to the stipulations of the novel statute, social media enterprises and virtual platforms are mandated to eliminate such material within a 48-hour timeframe upon receiving notification from the affected individual. These platforms must also implement strategies to eradicate copies of the offending content.

Federal Intervention in Online Content Moderation

Although numerous states have previously outlawed sexually explicit deepfakes and revenge porn, this legislation signals the initial instance of federal agencies intervening to enforce limitations on internet corporations.

Bipartisan Support and Motivation Behind the Law

Former First Lady Melania Trump advocated for the enactment of the bill, which was co-sponsored by Senators Ted Cruz (R-Texas) and Amy Klobuchar (D-Minn.). Senator Cruz indicated that his impetus for action stemmed from an incident where Snapchat allegedly delayed the removal of an AI-fabricated deepfake image of a 14-year-old girl for almost a year.

Concerns Over Free Speech and Potential Censorship

Advocates for freedom of expression and digital rights organizations have voiced worries, claiming the law is overly comprehensive and could potentially result in the censorship of legitimate imagery, such as permissible adult content, and possibly the suppression of government detractors.
