According to sources, the UK Foreign Office disseminated these advisories in light of legal counsel provided by her and other attorneys to the ICC, concerning a war crimes inquiry involving Israeli Prime Minister Benjamin Netanyahu and former Israeli Defense Minister Yoav Gallant.
US Sanctions on the International Criminal Court
This advisory emanates from US President Donald Trump’s signing of Executive Order (E.O.) 14203, which imposed sanctions on the ICC earlier in the year. The E.O. singled out British lawyer and ICC prosecutor Karim Khan, marking him as the inaugural barrister to face US sanctions for his role in the case.
The Order’s Claims
The executive order asserted that the court had engaged in “unauthorized and unwarranted actions” targeting both America and its ally, Israel. The ICC, it posited, had asserted jurisdiction without legitimate cause, instigated preliminary inquiries concerning US personnel and certain allies, including Israel, and abused its authority by issuing baseless arrest warrants directed at the Israeli Prime Minister and former Defense Minister.
The order further stipulated that the US would not shirk from bestowing “substantial and meaningful repercussions” on those accountable for the ICC’s offenses, potentially encompassing restringing access to property and assets, or prohibiting entry into the US for ICC officials, personnel, agents, and their immediate relatives.
