German Court Approves Deportation of Asylum Seekers to Greece

A leading German court has decided that two asylum seekers can be sent back to Greece despite acknowledged deficiencies in the nation’s immigration procedures. The Federal Administrative Court in Leipzig declared that the return of the migrants, originating from Gaza and Somalia, would not be considered inhumane or degrading treatment.

Court Affirms Lower Court Decision on Migrant Deportation

Both individuals, in their thirties, had previously been granted protection status within Greece. However, this status did not ensure adequate access to governmental aid. Consequently, the Federal Office for Migration and Refugees rejected their asylum applications in Germany, a judgment that was later supported by an administrative court in Hesse. While the court recognized shortcomings within the Greek asylum system, it asserted that the young and physically capable men should be equipped to manage these challenges.

Court Statement on Living Conditions in Greece

A press release from the Federal Administrative Court detailed the rationale behind the ruling:

“It is not foreseeably probable that able-bodied, healthy, and single young male beneficiaries of protection returning to Greece will face extreme material deprivation, preventing them from fulfilling their essential needs for housing, sustenance, and hygiene.”

The court further stated that the men would “likely” be able to secure “temporary shelters or emergency accommodations offering basic sanitation”.

Elaborating on support mechanisms, the court added:

“They can meet their other fundamental needs, including nourishment, through income earned by themselves, initially within the informal sector, supplemented if necessary by support services from relevant organizations. Emergency medical assistance and basic healthcare are assured.”

Concerns Raised over Asylum Numbers in Germany

This ruling occurs as incoming Chancellor Friedrich Merz announced Germany will decrease the intake of asylum seekers by 54% to prevent schools and hospitals from becoming “overburdened”.

CDU Leader Pledges Reduction in Asylum Figures

The head of the Christian Democratic Union (CDU) promised to reduce asylum numbers, which have already decreased by nearly one third in the prior year, in an effort to alleviate pressure on public amenities.

Strain on Public Services Cited as Reason for Policy Change

Speaking on German television, he stated: “Our stance is that these numbers must be significantly reduced. Maintaining a six-figure intake is no longer sustainable – towns, communities, schools, hospitals, and infrastructure are overwhelmed.”
