She further added, “Those who choose to attack and assault law enforcement will continue to be met with swift and severe punishment.”

Circumstances Leading to the Arrest

The alleged incident occurred in Roselle, New Jersey, on February 23rd, when ICE officers stopped Villegas-Alvarez after identifying him as lacking legal immigration status and subject to deportation proceedings.

Description of the Confrontation

According to the U.S. Attorney’s Office, Villegas-Alvarez “physically resisted arrest” and “forcefully elbowed” a female ICE officer in the face as authorities attempted to take him into custody.

Federal prosecutors detailed the officer’s injuries, stating, “As a result of Villegas Alvarez’s assault, the victim deportation officer sustained bodily injury, including a broken nose and a concussion from which she suffers severe post-concussion symptoms, including fainting and difficulty breathing.”

Events During the Arrest Attempt

The confrontation began when officers instructed Villegas-Alvarez to exit his vehicle.

Court documents reveal that while the Colombian national initially complied, he reportedly tensed his body and stiffened his arms when officers attempted to apply handcuffs.

Use of Taser and Subsequent Subduing

During the ensuing struggle, Villegas-Alvarez was reportedly tasered three times in the back. He briefly fell to the ground but then attempted to return to his vehicle.

Ultimately, the two ICE officers involved, including the injured officer, were able to subdue and apprehend Villegas-Alvarez.

Upcoming Court Appearance

Villegas-Alvarez is scheduled to be arraigned on Tuesday morning.
