Spanish rapper is cleared of slicing off his British flatmate’s penis after the Oxford graduate ‘victim’ told judges he mutilated himself because of gender issues

A Spanish rapper has been cleared of slicing off his British flatmate’s penis after the Oxford graduate told judges he had mutilated himself because of gender issues.

Andrew Breach, a 35-year-old English teacher, has also been told he will not face a perjury probe after the three sentencing judges turned down a request by prosecutors to charge him with false testimony.

Mr Breach claimed at Aaron Beltran’s two-day trial on March 1 and 2 he chopped off his own penis with a kitchen knife because of gender issues despite telling police his flatmate was to blame in one of his earlier statements.

Mr Beltran, 31, was facing a four and a half year prison sentence if found guilty of wounding his flatmate.

Police recovered the amputated sex organ from the apartment they shared with another four people including a teenage girl and it was successfully reattached in a hospital op.

Mr Breach, who has admitted to suffering mental health problems, was found covered in blood in the street below his Zaragoza home on March 8, 2019.

He told one of the two officers who went to his aid: ‘I have done it, I have done it’ before changing his story and pointing the finger at Mr Beltran in a later statement.

Prosecutors said in an indictment released ahead of trial Mr Breach offered his flatmate money to cut off his penis, saying payment would depend on the number of times a gory video of the amputation was viewed on social media.

The minimum payment would be £173 and the maximum £2,164.

But Mr Breach said in court at the start of the trial: ‘I cut my own penis off. 

‘It’s what I said in my first two statements and I know I changed it in my third statement but that was because I was under a lot of pressure from the police and I was scared. 

‘I was ill and I was worried that I would face charges. 

‘I don’t owe Aaron anything but at the same time I’m a man of conscience and I don’t want to send someone who is innocent to jail.’  

The sentencing judges, in a ten-page written ruling released on Tuesday, said it had been proven Mr Breach placed an ad on social media saying he was looking for a man to film him while he cut off his own sex organ.

But they said it had not been demonstrated Andrew had offered to pay his former flatmate as he claimed in one of his police statements he later retracted in court saying he suffered mental health problems and felt pressured.

Lead judge Alfonso Ballestin Miguel said in the written ruling: ‘There is reasonable doubt about who carried out the amputation.’

Identifying the Briton only by his first names and surname, he added: ‘Prosecutors have requested that Andrew S.B be investigated for the crime of perjury.

‘This court finds that is not appropriate because it doesn’t feel there is evidence of the commission of this crime.’

Barcelona-born Mr Beltran has performed under the artistic name of Sanatorio del Atico or Attic Sanatorium in English.

It was not immediately clear today if prosecutors would appeal the acquittal.
