Martin Lewis on what you can do if your energy company puts your rate up

Martin Lewis was asked a question by a viewer on his energy bills going up. The caller said: “Shell energy have advised that they are putting up my monthly payment for £72 to £84.

“I’ve been with Shell for a year and have always been in credit. My tariff is fixed until May 2021.

“If they do put my tariff up could I leave them without paying a cancellation fee?”

Martin revealed he can’t leave without a fee but he can make a complaint.

Martin replied: “No. You can’t leave the fixed term except for in the last 45 days without a cancellation fee.

“The fact they’ve put your payment up has nothing to do with the rate you pay, it’s to do with their estimating you’ll use more.

Martin Lewis gave energy advice to smart meter users in a recent TV appearances.

He advised someone whose energy bill had greatly increased since installing the meter.

He said: “Double or quadrupling your bill like you just said to me, that just shouldn’t be happening.

“You need to get on to the provider and say to them why is this happening? Can you detail to me what’s going on? Because this can’t be right.

“If that doesn’t work, if you think there is a problem then you need to complain to the ombudsman.”

“The other one, you said you paid a direct debit that was interest free, that might be a credit agreement.

“I don’t know, it depends how it’s structured.

“If that is a credit agreement then the company who is financing that are likely to be liable, or jointly liable for the retailer with the goods.

“You may want to go to the finance company. Go and look up Section 75, do some reading on that.”
